Q. Am I entitled to the disability element of Working Tax Credit?
A. To qualify, you must have a disability which puts you at a disadvantage in getting a job. To see if you meet the criteria, please call the Tax credits Helpline.
Q. Am I entitled to the severe disability element of Working Tax Credit?
A. In order to be entitled to the severe disability element, you, or your partner if you have one, must be receiving the Highest Care Component of Disability Living Allowance (HCC DLA) or Attendance Allowance at the Higher Rate (AA(HR)).
Q. My partner is the same sex. Do we complete a joint claim form?
A. Yes, from 5 December 2005, same sex couples are treated in the same way as opposite sex couples. Before 5 December 2005, you must claim as separate individuals.
Q. I have more than one wife/husband can I still claim for tax credits?
A. Yes, you will need to claim using the paper claim form. You must, on a separate piece of paper:
- Give your name and National Insurance Number (NINO).
- The name and NINO of the wife / husband whose details are on the form.
- The name, NINO and address of any additional wife / wives / husband(s) you have.
Once we receive your claim, we will contact you for further information (such as work details, other income).
Q. What is the Gender Recognition Act?
A. The Gender Recognition Act 2004 (July 2004) came into effect on 4 April 2005. It allows transsexual people to legally change their recorded gender and allows them to benefit from any rights and responsibilities that are associated to that acquired gender.
