Transitional Provisions Order 2005

There are a number of transitional measures that will be included in the Transitional Provisions Order 2005. The drafts now published set out the composite parts in individual orders covering the following measures:

• Equivalent pension benefits and state scheme premiums (PDF 88K) ( see also The Registered Pension Schemes (Authorised Payments) Regulations 2005 ) [technical note 1M]
• Pensions paid to dependant who has reached age 23 (PDF 81K) [technical note 4A]
• Prevention of second tax free lump sum (PDF 91K) [technical note 4G]
• Commencement provisions for unsecured pension funds (PDF 93K) [technical note 4H]
• Non Residents and transitional protection (PDF 88K) [technical note 4I]
• Compensation payments for purpose of valuing primary protection (PDF 84K) [technical note 4N]
• Contributions to overseas schemes (PDF 91K) [technical note 4M]
• Calculation of Retirement Lump Sums where there are pre-A-Day retirement benefits being paid (PDF 73K) [technical note 4O]
• Funeral expenses (PDF 88K) [technical note 4P]

When the final order is laid before Parliament this will be a single composite order comprising all the transitional measures to be dealt with by means of the Transitional Order. The measures for which draft orders are now published were all announced in the Technical note published on 16 February 2005 - The technical note reference is provided (PDF 117K) for each order for ease of reference.
