IR8: Winding-Up Petitions - Solicitor’s Office Enforcement Section

This leaflet explains why you have received this Winding-Up Petition and what will happen now.

We have started these proceedings because you owe us money. We will usually have taken other action to obtain payment and you have either not paid at all or made unacceptable proposals for settling the debt.

Is it too late to avoid winding-up proceedings?

You can avoid proceedings by making payment in full to our Enforcement & Insolvency Service (at Durrington Bridge House, Barrington Road, Worthing BN12 4SE).

Contact them immediately using the telephone number on the latest letter sent to you or the switchboard number 01903 700222, quoting the Enforcement & Insolvency Service reference in full.

Please do not telephone the Inland Revenue Solicitor's Office to discuss payment.

The Petition

The document you have is called a petition.

On it you will see that a date and time for the hearing has been set.

Hearings are held at the Companies Court, Royal Courts of Justice, Strand, London WC2A 2LL.

We will claim the costs of bringing the proceedings and add these to your existing debt.

Company hearings

These hearings are usually held in the main building. You can check the court list inside the main building on arrival or on the Court Service web site the day before the hearing. The hearing will usually be held in open court and the company will normally need to be legally represented if it wishes to address the court. However, if the court gives permission, it may be possible for an employee authorised by the company to appear on the company's behalf. A representative from the Solicitor's Office Enforcement Section will attend.

If you wish to discuss anything about the hearing you should contact us on the telephone number shown on the petition. We will not be able to discuss this at the time of the hearing, as there are no interview facilities at the court.
