The Social Security (Employment Training: Payments) Order 1988

The Secretary of State for Social Security, in exercise of the powers conferred upon him by section 26(1)(d), (2) and (4) of the Employment Act 1988185 and of all other powers enabling him in that behalf, hereby makes the following Order:
Citation, commencement and interpretation
1.-(1) This Order may be cited as the Social Security (Employment Training: Payments) Order 1988 and shall come into force on 4th September 1988.
(2) In this Order, "Class 1 contributions", "primary Class 1 contributions", "secondary Class 1 contributions" "and "Class 2 contributions" shall have the same meanings as in the Social Security Act 1975186.
Treatment of payments for purposes of the Social Security Act 1975

No primary or secondary Class 1 contributions shall be payable, and no person shall be liable to pay Class 1 or Class 2 contributions, in respect of payments to any person in receipt of a training premium under provision made under section 2 of the Employment and Training Act 1973187 [or section 2 of the Enterprise and New Towns (Scotland) Act 1990188]189, being payments under provision made under [190either of those sections] in connection with his use of facilities provided in pursuance of arrangements, known by the name of Employment Training, under [either of those sections]; and Part I (Contributions) of the Social Security Act 1975 shall be modified accordingly.

EXPLANATORY NOTE
(This note is not part of the Regulations)

This Order, made under section 26 of the Employment Act 1988 (c.19), modifies Part I of the Social Security Act 1975 (c.14), which makes provision as to National Insurance contributions.
Article 2 provides that payments made to persons undergoing Employment Training who are in receipt of a training premium shall not attract liability to pay Class 1 or Class 2 contributions.
