TQGN2350 - General principles: special requirements for certain quotas

Coniferous plywood

Goods covered by Tariff Quota 090013 include those described as 'Plywood..........the faces of which are not further prepared than the peeling process or sanded'. Plywood which has undergone further processes to repair minor defects are still entitled to relief. 'Unsanded' plywood may be described as 'plugged and touch sanded' (PTS) or 'touch sanded' (TS). Although these descriptions suggest that sanding has taken place, the goods are eligible under TQ 090013.

Handmade goods

Certain handmade goods qualify for TQ relief subject to certain conditions. The claim must be supported by a certificate given by the recognised authority in the country of origin (Word 38kb). The certificate must be in one of the official languages of the Community. It must contain the information in, and be in a similar format to, the example at Certificate in regard to certain handicraft products (handmade goods) (Word 39kb).

If you discover that the goods are not hand-made, despite a certificate, reject the claim.

Handloom fabrics

A quota is available for certain goods which:

  • have been woven on looms moved exclusively by hand or foot
  • are accompanied by a certificate of manufacture (Word 38kb) given by the recognised authority (Word 33kb) in the country of origin
  • carry on each piece a single lead seal or, at both ends, a stamp approved by the recognised authority and
  • are transported direct from the country of origin.

Quotas and preference prices

Certain wine, fish and agricultural quotas are subject to special procedures. Relief may be granted only when the import price for a particular commodity is equal to or greater than the reference price set by the Commission. Further details are available in the additional information pages at the end of the relevant chapters of Volume II of the Tariff. Reference prices for wine have been established and are in Tarif Integre Communitaire (TARIC) and at the end of Chapter 22. Those for fish and fish products are in TARIC and at the end of Chapter 03. Reject claims to TQ relief where the import price is lower than the reference price.

Cut flowers

The regulations which govern the Tariff Quotas for cut flowers from Morocco, Cyprus, Jordan and Israel contain a special mechanism. This allows for the suspension of the preferential rate of duty if, over a given period, it is found that certain price conditions have not been observed. The preferential rate of duty may be reintroduced at a later date if subsequently the price conditions are complied with. This procedure applies only to imports of large and small flowered roses, and uniflorous and multiflorous carnations. An email will be issued when information is received from the Commission. Reject claims for those products where the preferential rate has been suspended.
