Example of a SPP decision

That [e/e] is entitled to Statutory Paternity Pay for the period of one week/two* consecutive weeks commencing on [dd/mm/yy] at the standard rate of [£ amount] and that [e/r] is liable to pay Statutory Paternity Pay to [e/e] amounting to [£ amount].

NOTE

- the decision covers both the employee’s entitlement to the statutory payment and the employer’s liability to pay the statutory payment

• The decision covers the past period of known liability
• If necessary a further decision could be made in the future to cover a later period of the Paternity Pay Period but in practice this should not be necessary because the first decision will resolve the main issue of liability .

Example of SPP for one week only when entitlement to SPP is disputed

That [e/e] is entitled to Statutory Paternity Pay for the period of one week only commencing on dd/mm/yy] at the standard rate of [£ amount and that [e/r] is liable to pay Statutory Paternity Pay to [e/e] amounting to [£ amount].

[e/e] is not entitled to Statutory Paternity Pay for the week commencing 14 July 2006]*

NOTE

• The decision covers the period of entitlement but also
• If necessary a further decision could be made in the future to cover a later period of the Paternity Pay Period but in practice this should not be necessary because the first decision will resolve the main issue of liability .

* if the issue has been entitlement to SPP for the second week, for example because of the time limits for taking SPP, then add this period of “non entitlement” to the decision.
