Evidence for SMP

Evidence must be collected from both parties. Depending upon the nature of the dispute, the evidence will include a selection of the following:


  • notification of EWC and start of maternity leave
  • Maternity certificate MAT B1, see SPM20320
  • birth certificate of the child
  • employment issues:
  • status
  • continuous employment rule, see SPM20605
  • employment in QW, see SPM20605
  • work for liable employer during MPP, see SPM21105
  • work for new employer after baby is born, see SPM21110
  • earnings - AWE calculation, see SPM20800
  • medical evidence on whether or not absence is due to a pregnancy related illness
