SPM50520 - Medical Referrals - Incapacity for work

Medical Services able to offer an opinion

If Medical Services are able to offer an opinion about whether or not the employee is incapable of work send form SSP35 to the employer, giving the independent medical advice. The employer will decide whether to continue paying SSP.

If the employer decides not to pay SSP and the employee disagrees with that decision, they may ask HMRC to give a decision on entitlement. See DANSP07200

Or if the employee disagrees with Medical Services findings they may ask for a second opinion.
