Employee disputes pregnancy related illness

If the employee disputes that their incapacity is pregnancy related they can ask for a decision using form SMP56.

When a SMP56 is received by HMRC the following action should be taken:

• check for previous papers in case medical advice on this issue has already been given.
• make sure you have the employee's consent on form SMP56 or by issuing form SSP/SMP44.
• send an SMP42 to their doctor with a copy of the employee's consent, unless one has already been sent.
