Councillors in Scotland who are elected after 2 May 2007 will be
paid a salary.
HMRC’s position is that these Councillors are Office
Holders and the salary will be subject to PAYE and NICs.
As a consequence provided all the relevant conditions for
entitlement are satisfied they will be able to receive Statutory
Payments.
