Contract settlements and abatement: Extra for disclosure

The extra 10 per cent abatement referred to in SDLTM86610 should be given where

• there is spontaneous and complete disclosure
• the purchaser has no reason to fear early discovery

This extra 10 per cent will have the effect of covering part of the penalty loading remaining after the other two elements have been considered.

There will be occasions when, following a spontaneous disclosure, the extra 10 per cent will, with full co-operation, reduce the penalty loading to nil.
