Legislation: Failure to produce documents FA03/SCH10/PARA16: Determination

This may only be imposed on the authority of the authorised officer. The case must be referred to a Grade 6 officer for the purposes of imposing the initial £50 penalty under FA03/SCH10/PARA16(1)(a).

There must be evidence available within the papers to show that the proposed penalty action has been considered and approved by the authorised officer.

The penalty is fixed at £50 and must not therefore be imposed in any lower figure.

The authorised officer for FA03/SCH10/PARA16(1)(b) daily penalties must be a Grade 6 officer.
