FA03/SCH10/PARA14 requesting information from the purchaser: Offer to inspect documents

The purchaser may feel it is more convenient to have the documents inspected at their home or business, for example, if they are bulky or in current use.

The compliance caseworker should not ask for access in this way, but a spontaneous offer from the purchaser (an oral offer should be confirmed in writing) to allow examination of the documents at their premises should be carefully considered. Where the purchaser has an agent, it should be suggested that the agent should also attend.

The visit should be made by two officers, one of whom must be a compliance manager, and a clear record of what transpired, signed by the two officers, should be kept in the file.

If agreement is reached to examine the documents at the purchaser’s premises, the compliance caseworker should make it clear whether

  • it is accepted that the examination is a full discharge of the purchaser’s obligation to deliver under the notice
  • further information is still required, for example, if a document needs to be taken away for further examination or copying
