FA03/SCH10/PARA14 requesting information from the purchaser:
Opportunity to provide the information
The legislation states that the notice under
FA03/SCH10/PARA14(2) may be given at the same time as the notice of
enquiry.
However you would normally have already informally requested
the information and given the purchaser a reasonable period in
which to supply the information. See
SDLTM80980.
If an informal request has not been complied with, then a
formal notice under FA03/SCH10/PARA14 should be issued to the
purchaser, it should
- state that the purchaser is required to
produce the information by law
- setting out clearly what documents or
particulars are required
- advise that a penalty under
FA03/SCH10/PARA16 will be sought if the documents or particulars
are not produced by a specific date. The time allowed should be not
less than 30 days from the date of receipt of the formal notice but
more time may be given if, for example, extensive particulars need
to be compiled
- explain the purchaser’s right of
appeal against the notice under FA03/SCH10/PARA15
A copy of the notice under FA03/SCH10/PARA14 should be sent to
the purchaser’s agent.
