The approach of opening enquiries in a neutral way and limiting
a request for information to that reasonably relevant to the land
transaction return should be followed even if information is held
which appears to indicate that the return is incorrect.
Information provided in response to the initial request might
provide some confirmation of the inaccuracy of the land transaction
return.
If so a compliance caseworker should be able to request any
further information at the next stage of the enquiry. If however
this is not the case the compliance caseworker will need to
consider at that stage whether it should be discussed with the
agent, or the purchaser should be told that information held
suggests that their return is incorrect.
If there is an agent acting, any request for information
should be addressed to them and copy the letter to the
purchaser.
