Can an employer transact with a registered pension scheme?

It is permitted for the employer/member’s business to enter into most transactions, for example purchasing or selling an asset to or from the pension scheme. Any such transaction must be done on an arms-length commercial basis.

Where a transaction takes place between an employer and the pension scheme, which is not on an arms-length basis, the employer will be liable to an unauthorised payments charge.

There are restrictions on certain transactions, which are covered in the following pages.
