RPSM10104150 - Technical Pages: Death benefits: Pensions: Dependants' scheme pension: More than one dependants’ scheme pension paid
More than one dependants’ scheme pension paid following the death of the member
| [Para 16B(2), Sch 28][Para 28, Sch 10, FA 2005] |
The pension limit applies to the aggregate dependants’ benefits paid in respect of a member’s scheme pension. So that where
- there is more than one dependant for whom a dependants’ scheme pension is to be provided in respect of the member’s scheme pension, and/or
- more than one dependants’ scheme pension is to be paid to one dependant of a member in respect of that member’s scheme pension,
the pension limit is apportioned between the dependant(s) and/or
dependants’ scheme pension entitlements. How this is achieved
is explained on page
RPSM10104165 and
RPSM10104190.
If the dependants’ scheme pension payable to a
dependant exceeds the apportioned limit, only the excess will be
treated as an
unauthorised member payment.
