If you were a
member of an occupational pension scheme before 6
April 2006 and you had an unqualified right to take your benefits
before the
normal minimum pension age you may be able to
protect those rights to allow you to take your benefits before age
50 (or 55 after 6 April 2010). By an unqualified right we mean that
it is not dependent on anything. For example, if you do not need
your employer’s or scheme trustees’ agreement to take
benefits before age 50 (or 55 after 6 April 2010), this is an
unqualified right.
If you were a member of a
personal pension scheme or
retirement annuity contract before 6 April 2006
and had the right to take your benefits before age 50 you may be
able to take your benefits before normal minimum pension age
You do not have to register your protection with HMRC. Your
scheme administrator will be able to let you know
whether your pension age is protected.
