[Para 28 Sch 36]

Where the total value of an individual’s crystallised and uncrystallised lump sum rights on 5 April 2006 is more than £375,000 this section ( RPSM03105140 to RPSM03105182) applies.

This section does not apply if the total value of an individual’s crystallised and uncrystallised lump sum rights on 5 April 2006 is £375,000 or less.

If an individual with total lump sum rights of £375,000 or less has in any pension scheme uncrystallised lump sum rights of more than 25% of the value of their total uncrystallised rights in that scheme see RPSM03105500.

If an individual with total lump sum rights of £375,000 or less does not have uncrystallised lump sum rights of more than 25% of the value of their total uncrystallised rights in that scheme there is no lump sum protection. The normal payment rules for pension commencement lump sums will apply – see RPSM09104100.
