Re1202 - Maintenance payments: Child Support
Agency Assessments
Relief is due under the New Rules if
- a CSA assessment has been made under the
Child Support Act 1991 or the Child Support (Northern Ireland)
Order 1991 on an application by one party to a marriage and
- the other party to the marriage is the
parent of the child concerned and
- the payments by the other party
- are made to or through the DWP under Section 29 of
the Child Support Act or Northern Ireland Order 1991 or
- are retained under Section 43 of that Act or Order
by the DWP to compensate for increased Income Support or
Income-related Job Seekers Allowance paid for the child because of
the absent parent's failure to pay maintenance assessed by the
Child Support Agency on time.
The marriage condition was removed from Section 347B on 5
December 2005 and was changed to persons formerly living together
for the maintenance by the other person of a child of the family,
see Re1111a.
