RE1856 - Gifts of Land, Buildings, Shares & Securities to Charity: date of disposal

The date of disposal is the date on which the whole of the beneficial ownership of an investment passes to the charity. Usually, for the disposal of shares and securities, this will be the date on which the stock transfer form is signed.

For the disposal of land or buildings this will usually be the date on which conveyance of the property to the charity is completed.

However, where any of the following conditions apply the date indicated should be used:

  • If the disposal was made under a contract, perhaps a sale at below market value, the date will be the date on which the contract was made.
  • If the contract was conditional the date will the date on which all the conditions were satisfied
  • If the gift was made by a declaration of trust the date will be the date on which the declaration was made
  • If a lease was granted to the charity the date will be the date on which the lease was granted.
