Schemes with non-standard documentation may draft their own rule
amendments to adopt the flexibility provisions. The draft rule
amendments should be submitted to IR SPSS for approval before
execution. Refer any such amendments to PSTA for examination.
Alternatively, scheme trustees may adopt the provisions by
executing the following rule amendment:
"Notwithstanding anything to the contrary in the scheme
documentation the options in Parts I, II and III of Appendix XII
dated 08/2001 of IR 12 (2001) may be applied to the benefits of
scheme members with the consent of the Trustees."
It is the responsibility of scheme trustees to ensure that
the execution of the model rule amendment is compatible with the
scheme's existing powers of amendment.
