Where the Commissioners have awarded an initial penalty and the breach of the Regulations is still continuing eg, a PS 7013 is received without a copy of the loan agreement and this is still outstanding (see PSI23.1.11), issue a letter to the administrator, with a copy going to the practitioner, warning that they are potentially liable to ongoing daily penalties of up to £60 per day until the information/document is submitted. Then follow the procedure at PSI23.2.7.
