PSI19.1.13 - Withdrawal of Approval: General - Warning of Retrospection

Where there is even a possibility that approval may be withdrawn, it is essential to give a written warning at an early stage that if approval is withdrawn such withdrawal may take effect from a date earlier than the date of our warning letter. This warning has already been included in the relevant stock letters (PS7001 and PS7002 for example). Failure to include such a warning could seriously weaken the Revenue’s position if we subsequently withdraw approval retrospectively and our action is challenged at a Judicial Review. The flowchart at Appendix 1, which was published with PSO Update No 6 illustrates the normal steps leading up to withdrawal of approval.
