PSI18.1.13 - Application for Approval and Information Provisions: Application for Approval - Time Limit for Applications

Section 604(1) ICTA 88 requires an application to be made before the end of the first year of assessment for which approval is wanted. In view of the information requirements the Board accepts that some schemes may need further time to obtain the necessary details before making the application. The concessionary period is as follows:

In the month ending 5 Januaryby the following 5 July

In the month ending 5 Marchby the following 5 September
In the month ending 5 Aprilby the following 5 October

The "date scheme established" means the date on which there was first evidence of an intention to set up the scheme. Usually this will be the date of the declaration of trust notwithstanding any later commencement date referred to in the documents.
