PSI3.2.16 - Membership of Schemes: Proprietors, Partners and Other Persons Assessed under Schedule D - Marine Pilots

(This archived guidance relates to HMRC discretionary practice before the 6th April 2006. For current guidance on Registered Pension Schemes see the Registered Pension Schemes Manual)

Section 607 ICTA 88 provides for the approval under Chapter I, Part XIV ICTA 88 of a retirement benefits scheme for marine pilots. This statutory authority replaced the concessionary treatment under section 208 ICTA 1970 formerly accorded for historical reasons to the Pilots' National Fund for marine pilots whose earnings are not assessable under Schedule E. This is a rare, if not unique exception to the general rule that earnings assessed under Schedule D cannot be pensioned through an approved occupational pension scheme. The Fund is dealt with by Public Sector Section and any enquiries should be referred there.
