Handling An Employer Funding Appeal (AG)

To process an appeal against a funding decision, consider steps 1 to 11 below. The guide is presented as follows

Initial action	Step 1
Appeals made on time	Steps 2 – 4
Late appeals	Steps 5 – 9
Commissioners’ determinations	Step 10
Commissioners’ ruling on application for a late appeal	Step 11

1	Use Function VIEW EMPLOYER ACCOUNT to check if the appeal has been made within 30 days of the funding decision by the Accounting & Payments Service If the appeal has been made within 30 days, go to step 2 Otherwise Go to step 5

Check if the grounds for appeal are acceptable

Otherwise

If the grounds for appeal are acceptable

Use Function MAINTAIN FUNDING APPLICATION to amend the application in accordance with the appeal or agreement

If the grounds for appeal are not acceptable and you cannot reach agreement with the employer

5	Decide if the employer has a reasonable excuse for making an application for a late appeal If there is not a reasonable excuse, go to step 6 If there is a reasonable excuse, go to step 7
6	If there is not a reasonable excuse for making an application for a late appeal List the application for a late appeal for hearing by the General Commissioners. Follow the guidance in Listing Employer Funding Appeals For Hearing After the hearing, go to step 11
7	Check if the grounds for appeal are acceptable If the grounds for appeal are acceptable, go to step 8 Otherwise Go to step 9
8	If the grounds for appeal are acceptable Use Function MAINTAIN FUNDING APPLICATION to amend the application in accordance with the appeal or agreement Write to the employer and determine the appeal and take no further action
9	If the grounds for appeal are not acceptable List the appeal for hearing by the General Commissioners. Follow the guidance in Listing Employer Funding Appeals For Hearing After the hearing, go to step 10

10	If, at the hearing, the General Commissioners make a funding determination Use Functions MAINTAIN FUNDING APPLICATION to amend the application in accordance with the Commissioners’ decision

11	If the General Commissioners decide that the application for a late appeal Can be accepted follow this Action Guide from step 7 Is not accepted take no further action
