You must ask the claimant to make a fresh claim for tax credits
- When a change of circumstances has been received on a claim that has already been rejected
- When a change of circumstances has been received and the effective date of the change is either
- Prior to the start date of a finalised award
Or
- After the end date of a finalised award
- When the claimant was a single claimant when the original claim was made, but the claimant gets married or starts living with someone as if they are married
- When the claimant forms a civil partnership with a same sex partner or reports on or after 5th December 2005 that they are living with a same sex partner as if in a civil partnership
Note: The Civil Partnership Act comes into force on 5th December 2005. Two claimants of the same sex cannot be treated as a couple for tax credit purposes before that date
- When the original claim was made by a couple, but the couple have now separated and no longer live together
- When you are dealing with an entry on the 'Unprocessed Change Of Circs' Work List which shows that the claimant’s sex has been corrected on the frameworks, that is the claim was originally captured with the wrong sex, and this results in a same sex couple with entitlement before 5th December 2005
You may also decide that you need to advise the claimant to make a fresh claim for tax credits. For example
- The new information takes effect after the end date of the award and therefore, it does not make a difference to the award
- One of the claimants in a joint claim has died
