There is an Action Guide for this subject, click on 'Next
Page' to access it
The Department for Work and Pensions ( DWP) or Department for Social Development ( DSD) will notify Tax Credit Office ( TCO) that the claimant or child is entitled to Disability Living Allowance (DLA) or Attendance Allowance (AA) when
- An award of DLA or AA is made
Or
- There is a change in the DLA or AA award
This will only apply to cases where an award of tax credits has been notified to DWP / DSD, therefore registering a tax credits interest on the DLA or AA computerNotes:
- It is the claimant’s responsibility to inform the TCO of
any changes. This is explained to the claimant in the Award Notice
notes (form TC602). This includes the DLA or AA end date for an
adult
- If the claimant’s entitlement to DLA or AA ends and they
are working 16 hours or more, you must make further enquires to
establish if the claimant can still be treated as disabled for tax
credit purposes before you take any action
- If the claimant’s entitlement to DLA has reduced from the
highest rate care to middle or lowest rate care or has ended, or AA
has been reduced from higher rate to lower rate or has ended,
eligibility to the Severe Disability element will end. However,
this does not necessarily mean that the disability element of tax
credits will end. For more information about this, see
Disability
- If the claimant becomes entitled to DLA or AA and is subsequently entitled to the Disability element and / or Severe Disability element, TCO must be notified within 3 months of the date the DLA or AA decision was made
These notifications will be received at the post room. The post room will forward them to the relevant areas that will deal with this work.
