Withdrawing A Claim (AG)

To withdraw a claim for tax credits, consider steps 1 - 7 below. The guide is presented as follows

1Check for Compliance activity. Follow the guidance in Identifying Compliance Activity. If there is no Compliance activity, or Compliance do not require the claim, if the claim is being withdrawn due to
  • An operator error, go to step 6
     
  • A written request from claimant 1 or claimant 2, check the correspondence to see if it is signed
  • If it is signed, go to step 2
     
  • If it is not signed
  • Return the correspondence to the claimant requesting that they sign and then return it to the Tax Credit Office
     
  • Use Function CAPTURE APPLICATION and go to the Summary Information screen to record details of the action taken and the date the letter was returned in the Application Notes field
And to enter the following

'TCMZ Do not make a decision on this claim, withdrawal request letter returned to claimant 1 / claimant 2 for signature'

Note:Application Notes should not be added to withdrawn claims as this will incorrectly reinstate the claim

You must follow the guidance in How To Correctly Complete Application And Household Notes when you record the note

  • Take no further action
2Use Function CAPTURE APPLICATION and go to the Summary Information screen to determine whether the notice needs to be issued in a Special Needs format
  • If the notice does need to be issued in a Special Needs format
  • Make a note of the Special Needs format required
Then
  • Go to step 3
  • If the notice does not need to be issued in a Special Needs format, go to step 4
3Complete form TC865, which tells the claimant that their claim has been withdrawn. Then
  • If the form TC865 needs to be issued in a Special Needs format, go to step 4
     
  • If the form TC865 does not need to be issued in a Special Needs format
  • Send the completed form to the claimant
Then
  • Go to step 5
4If the Special Needs format is
  • Welsh
  • Fax the completed form TC865 to the Welsh Service provider for translation

Then

  • Go to step 5
  • Required in Braille, large print, or audio tape or disc
  • Fax the completed form TC865 along with a form TC648 to advise the Visually Impaired Media Unit (VIMU) of the action required

  • Go to step 5
Note: The converted form TC865 will be sent to the claimant by the Welsh Service provider or VIMU, as appropriate

5Note: Any Application Notes must be entered before the claim is withdrawn to ensure the claim is not reinstated incorrectly

On the Summary Information screen, enter the following in the Application Notes field

  • ‘TCMZ Notification of withdrawn tax credits claim sent’
And also record the following information
  • The date of issue of the form TC865
And
  • The date the claim was treated as withdrawn on
Note: The date that the claim is treated as withdrawn on is either the date stamped on the letter or if no date stamp is present, the date the claim was withdrawn on the computer. For example, ‘TCMZ Notification of withdrawn tax credits claim sent DD/MM/YYYY, claim treated as withdrawn from DD/MM/YYYY’

  • Go to step 6

6Use Function CAPTURE APPLICATION
  • Go to any screen other than the Log screen
     
  • Select ‘Edit’ on the toolbar menu
     
  • Select ‘Withdraw’ from the options available. You will be taken to the Withdraw Application screen
     
  • Go to step 7
7On the Withdraw Application screen, enter the reason for the withdrawal
  • Click on the [OK] button. The claim will be withdrawn

Note: You should not enter any further notes on the claim once it has been withdrawn as this will result in the claim being reinstated incorrectly
