You can withdraw a claim providing

  • A decision has not been made on the claim

And

  • The reason for the withdrawal is
  • Operator error, for example the same claim captured twice

Or

  • Claimant 1 or claimant 2 have requested that the claim be withdrawn in writing and the letter is signed

If either claimant 1 or claimant 2 have requested that the claim be withdrawn, you need to notify the claimant that their claim has been withdrawn. You must not notify the claimant if the claim has been withdrawn because of an operator error.

If the claim is post award, you will be unable to withdraw the claim.

Note: A claim cannot be withdrawn if a decision has already been made. The withdrawal of their tax credits claim does not affect the right of a claimant to submit a claim in the future
