MLR1PP9350 - Penalties Guidance: Alternative methods of calculating a penalty for multiple breaches: Introduction

The standard method for calculating a penalty for multiple breaches is basically the same method you would employ if there was only one breach. This is explained in Section MLR1PP9400

We can however choose to either calculate one single penalty for all of the breaches or calculate a separate penalty for each breach.

There are some circumstances when it is more appropriate to calculate a separate penalty for each breach. These are explained fully in Section MLR1PP9450

Which ever method is used the total penalty must be the same. If Officers arrive at a different amount using the two methods, there is an error in the calculation.

If the starting penalty is restricted to the minimum penalty of £5,000 the method is irrelevant and no additional starting penalty will be required. See MLR1PP8200
