MLR1PP12050 - Penalties Guidance: Escalated sanctions for serious or repeated non-compliance
The decision about which sanction is most appropriate for serious or sustained non-compliance, will depend on the individual circumstances.
The fundamental purpose of civil penalties is to persuade businesses who have previously failed to comply, to become fully compliant. The penalty escalator will ensure that the level of civil penalties increases significantly if, despite being given the opportunity to become compliant, a business or individual within this business fails to do so.
