MLR1PP10550 - Penalties Guidance: The range of penalty reductions

When a breach has occurred which is a result of a genuine mistake, a warning letter rather than a penalty will be issued.

When a breach occurred which is a result of a failure to take reasonable care, the penalty will range from a penalty notice without a financial sanction for the first breach with full disclosure to a maximum penalty of 70% of the starting penalty for the third breach when no disclosure has been made.

If the breach is a result of deliberate failure without concealment the penalty will range from 60% of the starting penalty for full disclosure where the consequences are not the most serious, to 100% with no disclosure and serious circumstances.

If the breach is a result of deliberate failure with concealment the penalty will range from 70% of the starting penalty for full disclosure to 100% with no disclosure.
