IPR100600 - Transfers between IPR authorisation holders: 3 copy SAD (suspension only)

paragraphs 5.11, 5.12 and Section 28. In addition to using the declaration procedure referred to in IPR100400, an IPR suspension authorisation holder will also have the option to transfer their suspension goods to another IPR suspension authorisation holder using a 3 copy SAD. No prior approval is required but as approval to use LCP is needed the 3 copy SAD cannot be used for receipts by simplified authorisation users. Discharge of the consignors IPR liability will not be made until receipt is noted in the consignees records. The receiving authorisation holder must hold a Local, Specific, Single or Integrated IPR authorisation, IPR60000. It can be used for IPR transfers within the UK or between Member States.

Goods transferred using a 3 copy SAD are not input to CHIEF so the responsible supervising offices must routinely monitor receipts and disposals by their traders, to ensure:


  • any goods received are covered by the authorisation held;
  • agreed throughput period(s) are not exceeded, IPR42700; and
  • suspension returns are submitted on time, IPR130300.

The authorisation letter must state how the supervising office is to be notified before each proposed transfers to other IPR holders (for example by email or fax ).This ensures that the supervising office(s) will be able to carry out any verification checks necessary. The supervising office for the consignor should always receive copy 1 of the SAD from their trader when each transfer is made. Transfer details should be noted in the traders folder and copy 1 of the SAD must then be forwarded to the supervising office responsible for the consignee.
