If the shadow director is either a bankrupt or a disqualified director, see INS45300 for action the Department can take to recover its debt from these shadow directors personally.

If such debt recovery action is not appropriate you may consider asking the liquidator to make a report to the DTI as taking part in the management of a limited company at a time when one is bankrupt or disqualified is a criminal offence. The DTI will consider what further action is appropriate, including the possibility of imprisonment.
