Compulsory winding up
Liquidator’s release from office (S174 IA 1986)
A liquidator obtains release from a compulsory winding up on
- resigning (the Official Receiver fills any vacancy
prior to the appointment, if any, of another liquidator)
- being replaced by order of the Court or following
a creditors’ meeting
- completion of the winding up or when the company
is dissolved.
Also a liquidator may be removed from office by order of the
Court or a special resolution passed at a creditors’ meeting
for that purpose.
A liquidator must also leave office on ceasing to be a
licensed practitioner.
