INS11309 - Responses to statutory
demand
Payment in full
If the taxpayer pays the statutory demand debt
- Further interest: as interest is only shown up to
the date of the demand, write requesting payment of the further
interest.
- Further arrears: you should mention any arrears
outside the demand to the taxpayer so they can arrange to clear all
the debts, including those that became due since the demand was
issued.
When payment in full received the Assistant Examiner is to
- Allocate it to the statutory demand
debt.
If the Case is settled
The E1 Assistant Examiner should
- Complete the Settled Case Checklist wizard
and pass the papers to the E2 to
- Put away (PA) the case.
Otherwise the Examiner is to
- Apply for interest
- Re-start proceedings when further arrears are not
paid (
INS11415). You may need to commence
fresh proceedings with a fresh statutory demand.
- Make a determination
- Return responsibility to the Recovery Office to
continue.
