Relevant date

The relevant date is used to determine

  • which debts are claimable in an insolvency
  • the amount of any preferential debt.

Debts incurred after the relevant date are not claimable in the insolvency except in voluntary arrangements when the non-preferential debt is determined by the date of the creditors’ meeting rather than the granting of an interim order.

The relevant date for each type of case is provided in Types of insolvency.

Although the term ‘relevant date’ is technically used to determine the preferential debt, for convenience it is also used for determining the non-preferential debt.
