Invitations to serve on committees

Once an insolvency practitioner (IP), other than the Official Receiver, is appointed the IP may call upon creditors to provide a representative to serve on a

• creditors’ committee in a bankruptcy
• liquidation committee in a liquidation.

The committee’s function is to supervise the administration of the insolvency. Such requests are more likely to be received at ICHU which will send them to the assessing office and liaise as necessary. The Recovery Office should send any requests received to the assessing office with a copy to ICHU. For an EIS case send the request direct to EIS.

In cases when the Official Receiver acts throughout committees are not applicable.

Scotland

Requests are usually made by the IP for a representative to act as a Commissioner in a sequestration (other than a ‘small assets’) case .

ICHU will immediately send any request to EIS Edinburgh with a copy of the claim. The Recovery Office should immediately send any request to EIS with a copy to ICHU.
