The settlor’s previous cumulative lifetime total (PLCT) is taken into account when calculating the rate of tax on chargeable trust events. It is the total value of chargeable transfers made in the seven years before starting the settlement. That is,
Use the chargeable value after annual exemptions, normal out of
income exemption and reliefs.
Disregard transfers made on the day the settlement commenced,
or any transfers before 27 March 1974. (
IHTM42130)
This amount does not fall out of cumulation by the passage of
time. It will be included in the calculation of every TYA charge
for as long as the discretionary trust continues.
Only chargeable transfers 7 years before death are cumulative.
Where there are additions to the trust, you may have to revalue the settlor’s PLCT for cumulation. ( IHTM42090) (IHTA84/S67)
