IHTM39016 - Future claims: additional entries made on F (Future) claims files


If there is more than one future claim you should enter them by noting each prospective claim on an entry sheet or elsewhere prominently in the file. From the entry it must be easy to identify readily, the interest or the property concerned. For example,

“Life interest of X under the deceased’s will/intestacy”

“Annuity of £y payable to Z for life under Clause 7 of the Settlement dated…..”

"Woodlands at Starkadder Farm passing to Robyn Giles" (as described in the valuation filed at sub file F)

You should also enter “IHF” in red opposite the note

You should enter each “F” marking in review date order on the file cover, together with the review date for each marking.

When a file is keyed with a future claim the registry

  • will arrange for the future claim review date to be entered on ALF,
  • mark the file to the off-site store on ALF
  • place a label marked ‘Future claim - do not destroy’ in the notes box on the front of the file cover, avoiding, if possible covering up any other relevant notes already written in the box.

The file can then be sent to store.

Any case that has previously been marked Open (Future Claim) and needs to be finally closed, should be clearly marked as such in the status box on the front of the file cover. If a future claim label has been placed on the file it should be made clear that this is no longer relevant. This will be shown by crossing through the writing on the label with a thick black pen.
