IDG61250 - Procedure for disclosing to others (government): Criminal Injuries Compensation Authority
(Please note that in this guidance CICA refers to the Criminal Injuries Compensation Authority and not the Crime International Cooperation Act).
Why share information with the Criminal Injuries Compensation Authority (CICA)
CICA is a Non-Departmental Public Body which administers the Criminal Injuries Compensation Scheme throughout England, Scotland and Wales. They sometimes require HMRC information to help process their customers’ compensation claims.
Ensuring information is shared lawfully
All disclosures of HMRC information must be lawful. Please see
IDG40500 for more information on lawful
disclosure as provided by the CRCA.
To be lawful, HMRC may only share information with the CICA
with the customer’s consent. See
IDG43000 for general information about
obtaining customer consent. The specific procedure for obtaining
customer consent in the case of CICA is outlined below. There is no
legal gateway with CICA.
Procedure to follow
You may receive a request for information directly from CICA, or it may be forwarded to you by the Centre for Research and Intelligence (CRI) (see IDG90100 for contact details). In either case the procedure is the same. In either case CICA will provide a copy of a form which details how the customer has provided us with consent to disclose their information to CICA (this will include a signature). You may then disclose only the information for which the customer has given their consent.
Devolved administrations
This guidance applies to the England, Scotland and Wales. In Northern Ireland, the Compensation Agency is the relevant body. If you receive a request from CICS in Northern Ireland, please deal with it in the same way as outlined above.
