Part II Schedule 12: fourth condition: not a Part I lease

The rule here is that Part I takes precedence. A Part II lease will be one which satisfies Paragraph 3(1) Schedule 12 FA 1997 (see FLM31.15) but does not satisfy at the same time the other four conditions.
