Ownership of leased assets
Ownership of leased assets is a complex legal issue (see FLM11.74) which does not usually merit detailed consideration except in the larger cases or where there is prima facie evidence of avoidance. In such cases there are two things to consider-
- purchase options in the lease agreement - see FLM12.49;
- nature of asset/what the lease payments are for - see FLM12.54.
