ECH3060 - ECTM Duties: Settlement Procedures
The ECTM should
- approve the proposed course of settlement before recovery action proceeds.
The degree of case paper examination needed will vary from review to review. However, the ECTM should always
- check that the papers record
- the nature and extent of each irregularity
- the person(s) responsible
- the reason(s) for the irregularity
- be satisfied that all proposed actions
- are correct, and
- conform to official guidance.

If the ECTM is not satisfied with an element of a review, because of for example
- inadequate investigation
- lack of information within the papers
- explanations which conflict with facts or lack credibility
they should
- discuss it with the ECO and
- where necessary return the review papers for further action.
