ECH3060 - ECTM Duties: Settlement Procedures

The ECTM should

  • approve the proposed course of settlement before recovery action proceeds.

The degree of case paper examination needed will vary from review to review. However, the ECTM should always

  • check that the papers record
  • the nature and extent of each irregularity
  • the person(s) responsible
  • the reason(s) for the irregularity
  • be satisfied that all proposed actions
  • are correct, and
  • conform to official guidance.
  • for reviews with potential penalties see ECH21120.

If the ECTM is not satisfied with an element of a review, because of for example

  • inadequate investigation
  • lack of information within the papers
  • explanations which conflict with facts or lack credibility

they should

  • discuss it with the ECO and
  • where necessary return the review papers for further action.
