ECH5020 - Legislation: Challenges to Authority
If an employer or contractor challenges your authority to
inspect records, you should
- refer the employer or contractor to Factsheet EC/FS1 or 2 (if appropriate) - reviewing your records, which explains
-
- why visits are made
- which records need to be seen
- what happens during the visit
- advise the employer or contractor to telephone the Strategic Manager or Senior Manager for confirmation of authority. If necessary the Strategic Manager may issue a letter of authority (for specimen letter of authority see ECH5030).
If the employer still denies access to records or refuses to
produce records refer to
ECH7112.
If the employer challenges the caseworker’s identity
see
ECH1050.
