ECH22050 - Settlement: Certificate of Disclosure


ECU staff do not normally need to seek certificates of disclosure during a Class 6 settlement but should

  • consider seeking them if any of the following conditions apply
  • they are not satisfied that the employer has adequately disclosed all benefits provided or remuneration paid and this seems to be the only practical way of checking
  • in particularly large cases, (This text has been withheld because of exemptions in the Freedom of Information Act 2000)
  • the employer has been the subject of a previous employer compliance settlement.

In all such cases emphasis must be given to the importance of the certificate and the serious view that the Board would take of incorrect certificates. This should be done by the ECTM or the ECUM.
