ECH11007 – Status: The Employment Status Indicator Tool
The Employment Status Indicator Tool is an electronic tool for
use in determining the status of workers.
The ESI tool will provide an opinion on the status of a
worker or group of workers by using information that reflects the
facts of the engagement.
The ECO should fact find in all cases where status is in
doubt ESM0525,
ECH11010. Once the facts have been
established the ECO should use the ESI tool to obtain an opinion.
Use of the ESI tool may not be appropriate where the facts of
the engagement are
- complex or
- contentious or
- contradictory
In such circumstances the ECO should
- consider all of the facts
- form an opinion on the workers status
- draft an opinion letter in accordance with ESM0110, ESM0111 and
- refer the letter and the relevant papers to the Status Inspector for approval and signature. ECH11022, ECH11030
In some circumstances the ESI tool will be unable to provide an opinion. In such circumstances the ECO should
- consider all of the facts
- form an opinion on the workers status
- draft an opinion letter in accordance with ESM0110, ESM0111 and
- refer the letter and the relevant papers to the Status Inspector for approval and signature. ECH11022, ECH11030
