Remunerative work: general

To be in remunerative work a person must
1) work for 16 hours a week or more (12040 onwards and
2) work for payment or in expectation of payment (12001

onwards) and

3) be employed at the date of application (DMG12110) and
4) satisfy one of the following conditions

4.1) work 16 hours or more in

4.1a) the week of application or

4.1b) one of the 2 weeks immediately before the week of application or

4.2) be an employed earner who is expected by the employer or by themselves if S/E, to work 16 hours or more in the week immediately following the week of application or

4.3) cannot satisfy 4.1 or 4.2 above and are on holiday at the date of application (WFTC applications), or cannot satisfy 4.1 or 4.2 because they are on holiday in those weeks (DPTC applications), but they are expected by their employer or by themselves if S/E, to work 16 hours or more in the week following their return to work from that holiday, or

4.4) cannot satisfy 4.1 or 4.2 above and are on jury service at the date of application but are expected by their employer or by themselves if S/E, to work 16 hours or more in the week following their return to work from that jury service (awards commencing on or after 28.11.00)

Note If a person applies for WFTC or DPTC during a school holiday they are in employment if their contract of employment continues throughout that school holiday.
